(commercially Working Link SA de CV) is governed by the\nprinciple of corporate integrity under Mexican and foreign laws that apply and is\ncommitted to the legitimate use of personal and sensitive data, guaranteeing its\ncontrolled management.<\/p>\n<p>In terms of the provisions of articles 15 and 16 of the Federal Law on Protection\nof Personal Data Held by Private Parties and the principle of \u201cconsent\u201d included\nin article 11 of the regulations of the law mentioned above, you are informed of\nthe privacy policy and use of personal data so before providing us with any kind\nof information, you grant your consent for its controlled handling, so we set\nout the terms in which your information will be transferred according to the\nfollowing:<\/p>\n<p><strong>Comprehensive privacy notice<\/strong><\/p>\n<p><strong>I. Responsible.<\/strong> VanZar Link SA de CV (Working Link, S.A. de C.V.) is an organization regulated by the Ministry of Labor and Social Welfare with authorization number STPS-ACT-VLI09-00250, issued on May 28, 2014, with address at Avenida Insurgentes Sur No. 1700, 7th floor, Col. Florida, Del. Alvaro Obreg\u00f3n, M\u00e9xico City. C.P. 01030, with website <a href=\"http:\/\/www.workinglink.mx\/\">www.workinglink.mx<\/a><\/p>\n<p><strong>II. Data collected subjected to processing.<\/strong> VanZar Link, S.A. de C.V., captures\nthe data to which it is obliged in accordance with the legal and regulatory provisions that regulate it, as well as those necessary for the development of its activities and commercial relationships, considering the following:<\/p>\n<p>a) Personal. Name, address, date and place of birth, sex, marital status, matrimonial regime if applicable, nationality, landline telephone number and\/or mobile telephone number, fax number, email address, Federal Taxpayer Registry, Unique Code of the Population Registry (CURP), signature, name of spouse, occupation, photographs, videos, interviews and in general images in which the owner of the same appears; information about academic and work\nbackground (previous jobs); and data relating to interest in jobs; skills and abilities; and job requirements (including salary).<\/p>\n<p>Likewise, for the proper exercise of the company's activities, the following information will be collected:<\/p>\n<ul>\n<li>Transit data and migratory movements: Declaration by the owner of the data regarding cross-border mobility that he or she has had in the past, such as: entry (legal or illegal) to other countries, deportation procedures, or any procedure related to migration that has been subject.<\/li>\n<li>Data from administrative and\/or jurisdictional procedures: Declaration of the owner of the data regarding trials followed against him, as well as the result of these and, where appropriate, whether he has been deprived of his liberty and the crimes that gave rise to it.<\/li>\n<li>Biometric data: Fingerprint in cases where the owner is not in a position to express in writing his consent to the various acts of the company's\nprocedures, and especially regarding the privacy policy and use of personal data, to which VanZar Link, S.A. of C.V. is obliged to inform you of\nthe contents of this document.<\/li>\n<\/ul>\n<ul>\n<li>Financial data. Data on increases in assets, income, tax payments, total expenses and remittances sent to Mexico derived from the income obtained from work in Canada.<\/li>\n<\/ul>\n<ol>\n<li>Sensitive. VanZar Link, S.A. of C.V. will not request in any way, and the owner of the data will not provide at any time, \"sensitive personal data\", understood as those that are intimate personal data or whose improper use could give rise to discrimination or entail a serious risk for the Owner, Therefore, you are obliged not to provide any information related to your racial or ethnic origin, genetic information, religious, philosophical and\/or moral beliefs, union membership, political opinions and\/or sexual preference.<\/li>\n<\/ol>\n<p>An exception to the above is obtaining data that indicates the health status of the holder for purposes strictly linked to the evaluation of capabilities to protect the physical integrity of the holder himself, without this being able to constitute a reason for any discrimination.<\/p>\n<p><strong>III. Purpose of data processing.<\/strong> The data collected by VanZar Link, S.A. of C.V.<\/p>\n<p>a) Primary Purpose: In compliance with the activities that are authorized:<\/p>\n<ul>\n<li>Comply with the obligations derived from the activity as a for-profit worker placement agency, as well as inform the competent authorities regarding the activity in the terms established in current laws and regulations.<\/li>\n<li>Transmit necessary information for the purpose of promotion to third parties abroad and thus be able to link them to employment (free of charge for the owner of the data) in the terms established by the applicable laws and regulations. \n\nThe information includes: The promotion of job offers to third parties, any related to that requested by the authorities of Mexico, and any country related to the immigration process that may occur without any restriction.<\/li>\n<\/ul>\n<p>b) Secondary Purpose: To contribute to the activities it carries out, VanZar Link, S.A. of C.V. may use your data to:<\/p>\n<ul>\n<li>Promote the main activity of the company in newspapers, magazines, visual media, television, and social networks with the purpose of free\nemployment for the data Owner, so can use your personal data as they are: name, photographs, videos, interviews, publications and any other\nmeans of advertising known or unknown.<\/li>\n<li>Send information about your data by any means of communication to companies with which the person responsible has a commercial or business relationship that can offer services to the Owner, such as: travel agencies, life, medical or other insurance, processing and expedition of international driver's licenses, personnel transportation, national and foreign educational institutions, as well as various services.<\/li>\n<\/ul>\n<p>It is important to consider that although these purposes are not necessary to provide free employment services to the Owner, they are intended to improve your experience with our service.<\/p>\n<p>If you do not want your personal data to be processed for secondary purposes, you can express this from the moment you provide us with your personal data and through the mechanism described below.<\/p>\n<p>Refusal to use your personal data for these purposes may not be a reason for us to deny you the services and products you request or contract with us.<\/p>\n<p><strong>IV. Transfers of personal data.<\/strong> The Owner acknowledges and accepts that\nVanZar Link, S.A. of C.V. does not require authorization or confirmation from said\nOwner to carry out transfers of national or international personal data in the\ncases provided for in Article 37 of the Federal Law on Protection of Personal Data\nHeld by Private Parties and especially as established in section:<\/p>\n<p><em>IV. When the\ntransfer is necessary by virtue of a contract concluded or to be concluded in the\ninterest of the Owner, by the person responsible and a third party.<\/em><\/p>\n<p>In this way, VanZar Link, S.A. of C.V. may transfer the personal data it collects to\nnational or foreign third parties, with the understanding that the treatment that\nthese third parties give to the Owner's personal data must comply with the\nprovisions of this Privacy Notice.<\/p>\n<p><strong>V. Online data collection and security protocol<\/strong> <strong>de VanZar Link, S.A. de C.V.<\/strong> VanZar Link, S.A. of C.V. may\ncollect data through its internet page through the use of cookies, understood as\n\"cookies,\" the data file that is stored on the hard drive of the user's computer,\nwhen the user has access to the company's page. These files may contain\ninformation such as the identification provided by the user or information to\ntrack the user's preference pages, monitor their behaviour as an internet user,\nand deliver them with a better service and user experience when browsing our\npage.<\/p>\n<p>A cookie cannot read data or information from the user's hard drive or read\ncookies created by other sites or pages. If you wish to reject cookies or accept\nthem selectively, you can do so by adjusting your browser preferences.<\/p>\n<p><strong>VI.<\/strong> <strong>Conservation and security of personal data. <\/strong>The Controller and\/or its\nmanagers will retain the personal data of the Owner for as long as necessary to\nprocess the procedure, as well as to maintain the accounting, financial and audit\nrecords in terms of the Federal Law on Protection of Personal Data Held by\nIndividuals and the necessary information in terms of the Regulation of Worker\nPlacement Agencies and the other applicable legal provisions.<\/p>\n<p>The personal data of the Owner collected by the Controller and\/or its managers\nwill be protected by appropriate administrative, technical and physical security\nmeasures against damage, loss, alteration, destruction or unauthorized use,\naccess or treatment in accordance with the provisions in the legal, regulatory and\nadministrative provisions mentioned in the previous paragraph.<\/p>\n<p><strong>VII. Procedure to exercise \u201cARCO\u201d rights. <\/strong>The Owner, or through his\nrepresentative, has the right to access the personal data that has been\nauthorized us to process, as well as to know the information related to his\nprocessing conditions and to rectify them if they are inaccurate or incomplete. In\n\naddition, he may request VanZar Link, S.A. de C.V. at any time the cancellation of\nhis personal data when considering that are not being treated in accordance with\nthe principles and duties established <em>by the Federal Law on Protection of\nPersonal Data Held by Private Parties <\/em>and its regulations, as long as the above is\npossible in terms of the obligations imposed on the Owner by the Regulation of\nWorker Placement Agencies and other applicable legal provisions.<\/p>\n<p>VanZar Link, S.A. de C.V., has implemented as a mechanism for exercising said\nrights, \u201cARCO,\u201d the making of your request to exercise your rights preferably by\ntelephone or through the means indicated in the preceding section of this\ninstrument.<\/p>\n<ol>\n<li><strong>Request from the Owner. <\/strong>After full identification, the Owner may make his or\nher requests by providing the following information:\n<ol>\n<li>The full name of the Owner.<\/li>\n<li>Address and\/or email address to communicate the response to his\nrequest.<\/li>\n<li>Date of birth.<\/li>\n<li>The clear and precise description of the personal data concerning which\none seeks to exercise any of the rights mentioned above, and,<\/li>\n<li>Any other element or information that facilitates the location of your\npersonal data.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ol>\n<li><strong>Request through third parties. <\/strong>The request to exercise ARCO rights may be\nasserted directly by the Owner or through a legal representative.\nThe representative must prove his or her mandate before exercising any ARCO\nrights (the mandate is accredited with a simple copy of the power of attorney,\nattaching their corresponding official identification \u2013 voter ID, passport, Multiple\nImmigration Form (FMM) or its equivalent).<\/li>\n<\/ol>\n<p><br><\/p>\n<p>In the case of requests to rectify your personal data, you must also indicate the\nmodifications to be made and provide the documentation supporting your\nrequest.<\/p>\n<p>The exercise of ARCO rights, regardless of whether the Owner or a third party\npromotes them, may be exercised by telephone, email or at the address of\nVanZar Link, S.A. of C.V., which are described in the preceding section of this\ninstrument.<\/p>\n<ol>\n<li><strong>Deadlines and procedures. <\/strong>In terms of what is established by the law on the\nmatter, VanZar Link, S.A. of C.V. has a maximum period of twenty business days,\ncounted from the date on which the request for access, rectification, cancellation\nor opposition was received, to inform the Owner of the determination adopted,\nso that, if appropriate, the same is made effective within fifteen business days\nfollowing the date on which the response is communicated to the Owner.<\/li>\n<\/ol>\n<p>In the case of requests for access to personal data, the Controller will proceed\nwith its delivery, after accreditation of the identity of the applicant or his legal\nrepresentative, as appropriate, by issuing simple copies or electronic documents,\nfree of charge, except for the costs of shipping or the cost of reproduction in\ncopies or other formats. Suppose the Holder reiterates his request in a period of\nless than twelve months. In that case, he must cover the corresponding costs\nequivalent to no more than three days of the Minimum Wage in Force in the <em>Ley Federal de Protecci\u00f3n de Datos Personales en Posesi\u00f3n de los Particulares <\/em>unless there are substantial modifications to the\nPrivacy Notice that motivate new queries.<\/p>\n<p>For the purposes of requests for cancellation of personal data, in addition to the\nprovisions of this Privacy Notice, the provisions of article 26 of the Federal Law\non Protection of Personal Data Held by Private Parties will apply, including cases\nof exception for cancellation of personal data indicated there.<\/p>\n<p><strong>IX. Revocation, limitation on the use or disclosure<\/strong> <strong>of your personal data.<\/strong> So\nthat you can revoke and\/or limit the use or disclosure of the consent that you\nhave given us for the processing of your personal data, at any time, so that we\nstop using it, except in the cases established in Article 10 of the Federal Law on\nProtection of Personal Data Held by Private Parties, and VanZar Link, S.A. de C.V.,\ncan attend to your revocation request, the Holders must provide the information\nindicated in section VIII, established in advance, to our address located at\nInsurgentes Sur No. 1700, 7th floor, Col. C.P. 01030 or through the means indicated in section VII of this Notice.<\/p>\n<p>VanZar Link, S.A. de C.V., will respond to your request within a maximum period\nof fifteen business days following receipt of your revocation request and will\ninform you of its proceeding by sending an-email to the electronic address\nindicated by you in your application.<\/p>\n<p><span style=\"background-color: transparent; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align);\"><strong>X.<\/strong>&nbsp;<\/span><strong style=\"background-color: transparent; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; text-align: var(--text-align);\">Modifications to the Privacy Notice. <\/strong><span style=\"background-color: transparent; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">VanZar Link, S.A. of C.V. reserves the\nright to periodically update this Privacy Notice in accordance with changes in our\ninformation practices in response to legislative developments, internal policies\nor new requirements for providing our services.<\/span><\/p>\n<p>These modifications will be available to the public through our internet page so\nthat the Owner may consult them on the site <a href=\"http:\/\/www.workinglink.mx\/\">www.workinglink.mx<\/a> It is\nrecommended that the Owner consult our Privacy Notice, at least semiannually,\nto be updated on the conditions and terms thereof.<\/p>\n<p>The Responsible Party will understand that, if it does not express otherwise, it\nmeans that the Owner has read, understood and agreed to the terms set forth\ntherein, which constitutes its consent to the changes established in the updates\nto this Privacy Notice regarding the processing of its Personal Data for the\npurposes of the Federal Law on Protection of Personal Data Held by Private\nParties and other applicable legislation.<\/p>\n<p><strong>XI. Consent to the terms of the privacy policy and notice. <\/strong>The Owner must\ngrant their consent when their data is collected, for which they will be informed\nof the simplified privacy notice where the existence of this document is\ntransmitted to them for verification, which constitutes a legal agreement\nbetween the parties.<\/p>\n<p><\/p>\n<p><strong>XII.
